Management of Selling Case Study Example | Topics and Well Written Essays - 2500 words

Management of Selling - Case Study Example These measures would be particularly helpful because it would gain the co-operation of the sales force during the investigation process, which would provide more satisfactory results. Oldroyd would require the following information: An insight of the highly dissatisfied A and B accounts who are about to move out from the customer list. This would help Oldroyd to know the problems of the company in detail and its product acceptance in the market. By accompanying the sales force to gather this information will not only ensure their co-operation but they would also feel that their boss is by their side in difficult times. Oldroyd will gain confidence of his sales force in this way. The salesmen are sure that the salary would keep on increasing even if they make minimal effort in getting fresh orders as they have spent a number of years with the company which is well above the average duration of stay for sales people in the industry. Hence there is no pressure on the sales force as job security is high. There is no scheme of incentive for those who get the highest number of orders or for those who over perform. There is also no system of cutting some amount of money from the salary due to underperformance. So each month the salary of the sales force is guaranteed even if they under perform. ... The inner feelings of each salesman and their complaints if any. 2. There are many disadvantages in the way the sales force is currently organised. They are as follows: It is difficult to properly monitor the sales force The salesmen are sure that the salary would keep on increasing even if they make minimal effort in getting fresh orders as they have spent a number of years with the company which is well above the average duration of stay for sales people in the industry. Hence there is no pressure on the sales force as job security is high. Sale in the company is due to 10 years of brand reputation in the market and not due to any effort by the sales force. There is no scheme of incentive for those who get the highest number of orders or for those who over perform. There is also no system of cutting some amount of money from the salary due to underperformance. So each month the salary of the sales force is guaranteed even if they under perform. Hence each of them is assured of his own personal income and do not bother about the company's overall growth. Since there is no incentive scheme, in the words of Dive (2005, p. 13) there is "slow reaction to customers and competitions" which results in "quality work not being done.." There is rather unclear or total lack of vision for the sales force. They themselves are not sure where they are heading. 3. In the next six months Stephen Oldroyd can improve the sales performance of his company in the following ways: He should set up a future course of action and communicate it effectively to the sales force. He should demonstrate his best planning skills because the sales department of Supplies-4-Gardens seriously

Definition of fixed cost and variable cost

Definition of fixed cost and variable cost Fixed cost (FC): is a cost that remains constant, in total, regardless of changes in the level of activity. Fixed costs are not affected by changes in activity. Consequently, as the activity level rises and falls, total fixed costs remain constant unless influenced by some outside force. But fixed cost per unit decreases as the activity level rises and increases as the activity level falls. (Garrison etal., 2006, P49). Fixed costs include salaries of executives, interest expense, rent, depreciation, and insurance expenses. . Variable cost (VC): is a cost that varies, in total, in direct proportion o changes in the level activity. The activity can be expressed in many ways, such as units produced, units sold, miles driven, beds occupied, lines of print, hours worked and so forth. But variable cost per unit remains constant. ((Garrison etal., 2006, P48). Direct cost, indirect cost and overhead costs Direct costs: is a cost that can be easily and conveniently traced to the particular cost object under consideration. The concept of direct cost extends beyond just direct materials and direct labor. (Garrison etal., 2006, P50). Example: the salary of supervisor in marketing department is the direct cost for marketing department. The salary is likely the same each month not depend on the quantity of sales product. Indirect costs: is a cost that cannot be easily and conveniently traced to the particular cost object under consideration. (Garrison etal., 2006, P50).   Each business has its own method of allocating indirect costs to different products, sources of sales revenue and  business units.  Business managers and accounts should always keep an eye on the allocation methods used for indirect costs. Example: Depreciation on the production machine is also an indirect product cost, it stays the same each year not depend on the volume produced on the machine. Costs can be direct and indirect depending on the cost object: product, department,  and others such as division, customer, or geographic market. The total amount of the  cost remain the same as volume changes, it is fixed cost. It is a variable cost if the total cost change in proportion to the change in the activity or volume. Overhead costs: the indirect recurring costs of running a business that are not linked directly to the goods or service produced and sold. Overhead costs can include payments for the rent of premises, utility bills, and employees salaries. Controllable costs and uncontrollable costs Controllable cost: are those costs which can be regulated or controlled by specified member of an undertaking. Most of the variable costs are controllable costs. For example, direct material, direct labor and direct expenses à ¢Ã¢â€š ¬Ã‚ ¦are controlled by the lower level of management. Uncontrollable cost: can not be controlled by the specified member of the undertaking. Most of the fixed costs are uncontrollable cost. For example, factory rental expense, supervisors salary, depreciation. Evaluate the statement I have trouble with the terminology-direct costs, also called variable costs, are the ones that are controllable. Whereas indirect costs or overheads, also called fixed costs, are uncontrollable. Based on the definitions above, I strongly disagree with the statement because the delegate assumed wrongly about the cost. There are many ways to classified cost depending on the purpose of management. According to association with products, costs are divided into product costs and period costs. According to identifiably, costs are divided into direct cost and indirect cost. According to behavior, costs are divided into fixed cost, variable cost and semi- variable cost. According to controllability, costs are divided into controllable costs and uncontrollable costs. Direct cost can be fixed cost and variable cost depending on situations For example: the salary of supervisor in manufacture department is the direct cost for manufacture department. The salary is likely the same each month not depend on the quantity of product. It is a fixed cost of manufacture department. Raw material supply for manufacture department is a direct cost for department but it is a variable cost, total amount of supplies use in the department increases if the volume in the department increases. Indirect costs can be fixed costs and variable cost also: In opposition to direct cost, most of indirect cost is fixed cost. For example rental cost is indirect cost for part production, it is a fixed cost of manufacture department stay the same each month, its not depend on the number of product. But indirect cost can be variable cost also. The cost of electricity for administration of manufacture department is variable cost monthly depending on the number of electricity use more or less. Controllable cost and uncontrollable cost Most of variable costs are controllable. To illustrate: low level manager in manufacture product is the direct monitoring and control of production process. They can be managing the raw material use to create product and direct labors that mean control the number of employees needed to complete product. Management can organize the use of resources effectively in the short term. On the other hand, many of fixed costs are uncontrollable. They are imposed in terms of management such as business can not decide the rental fees of factory, the rent for his unit negotiated by higher management, or the rates dictated by the local authority. Question 2 1. Participative budgeting Budget preparation is the process by which organizational goals are translated into a plan that specifies the allocated resources, the selected processes, and the desired schedule for achieving these goals. There are two main types of budgeting: bottom-up budgeting and top-down budgeting. Participative budgeting is a method of preparing budgets in which managers prepare their own budgets. These budgets are then reviewed by the managers supervisor, and any issues are resolved by mutual agreement. Manager Marketing Manager Sales Vice President Sales Vice President Finance President and CEO Vice President Production Cashier Controller Manager Manufacturing Manager Distribution All level of an organization should work together to create the budget. Each level in organization should contribute in the way that it best can in a cooperative effort to develop budget. Lower level management is responsible for setting the estimate of budget data in a participative system and submits them to the next higher level of management. Before the budget is accepted, they must be reviewed and evaluated by middle management before they are transferred to the organization. Advantage of participative budgeting Participative budgeting is relevant to all member of particular project, it helps to encourage all participants contribute idea to built a project effectively. Budget information is given clearly and fairly accurate because it use of the data available at the project management level Working motivation is higher when an individual directly involved in setting goals rather than goals imposed from above. Self-imposed budget made commitments to implement the goals. If the budget has been setting from top management, managers can say that budget is unreasonable or impractical to start, could not be performed. With participative budget, it does not happen when the managers set a budget for themselves. Disadvantage of participative budget Time consuming and costly because too many participants involved in setting budget project. The influence of top manager is limited over the budget process. However, when the lower-level managers plan the short budgets and mid-range budgets, outlining organizational policies and goals, they can influence the outcome by issuing a statement. Individual tend to overstate the real resource needs because they think that all budget will be cut in certain proportion by top manager and set a goal lower than actual for easy to achieve the goal. 2. Budget variance a. Definition of budget variance: Total budget variance is simply the difference between the actual cost of the input and its planned cost. Total variance = Price variance + Usage variance In standard costing systems, the total variance is broken down into price and usage variance. Price variance is the difference between the actual and standard unit price of an input multiplied by the number of unit used. Usage variance is the difference between the actual and standard quantity of inputs multiplied by the standard unit price of the input. Total variance = (AP x AQ) (SP x SQ) ACTUAL COST (AQ x AP) STANDARD COST (SQ x SP) STANDARD COST (SQ x SP) ACTUAL COST (AQ x AP) > FAVORABLE VARIANCE (ACTUAL UNFAVORABLE VARIANCE (ACTUAL > STANDARD) AQ means the actual quantity of input used to produce the output AP means the actual price of the input used to produce the output SQ means the standard quantity SP means the standard price Favorable variance and unfavorable variance are not equivalent to good and bad variance. The terms indicate the relationship of the actual price or quantities to the standards prices and quantities. b. Budget variance investigation Managers responsibility is carefully calculated the variance because that is a part of effective control of organization. In general, it is difficult to manage external sources of budget variance (government policy, stock market, fluctuation of exchange rateà ¢Ã¢â€š ¬Ã‚ ¦) rather than internal sources (raw material, cost per hour on direct labor). Management should know about the acceptable range of performance. If the budget has a favorable balance that means it has brought the profit to the company. Conducting an investigation to find out the reason why the variance of budget was favorable and it could be made more than in the future. If the variance is small, it should not be too worried. In fact, a little variance between actual budget and the projected figures is always happens. With the very small difference, the manager can ignore them, no need to adopt strong action because it does not bring terrible consequences for the business. So, with little difference, the best way to solve is simply putting it into stride. If the budget has unfavorable variance, head of department need to conduct an investigation to find out the main causes by external influence or internal influence. For example the increase of raw material usage per unit more than allowed standard because it was poor condition of machine or poor manufacturing. Find the cause and how to fix the problem; it is a good measure to prevent a similar situation may occur in the future. After having adverse variance the budget needs to rewrite or the budget needs to verify by internal audit. Question 3 Explain the term used in the statement 1. Committed fixed costs Committed fixed costs relate to the investment in facilities, equipment, and basic organizational structure. The two characteristics of committed fixed costs are that they are long term in natural, and they cannot be significantly reduced event for short periods of time without seriously impairing the profitably or long- run goals of the organization. Even if operations are interrupted or cut back, the committed fixed cost will still continue largely unchanged (Garrison etal., 2006, P190). For example: Vietnam airlines has total 80 aircraft, the company must pay money for depreciation, maintenance and insurance expense. The expense is not depend on the number of times the plane fly or the number of passenger in plane. It is a committed fixed cost. Decisions to acquire major equipment or to take on other committed fixed costs involve a long planning horizon. Management should make such commitments only after carefully analysis of the available alternatives. Once a decision is made to acquire committed resources, the company may be locked in to the decision for many years to come (Garrison etal., 2006, P191). For example the total committed fixed cost of renting the building for the hotel is very high and the company must commit to pay for it at least 5 years in Vietnam. Uneven revenue flows It is showed that the difference of demand (low or high) for product or service in different periods. At times the company is very busy and at others it suffers from very slack periods. The hospitality industry is often divided into two distinct seasons: high season and low season. The period time between two seasons can move and change each year. In high season, the hotel does not have enough room for customer and the room rate is very high that bring large of profit for the hotel. In contrast, in low season the hotel must reduce the price and apply promotion to attract tourist. It is a common situation of hotel and resort. The implication of the above situation for the company Many of our cost are committed fixed cost. Our revenue flows occur very unevenly. To be profitable we have to take a flexible approach to pricing The company in hospitality industry has large proportion of fixed cost for the initial investment so the break even point is also very high. Company will operate with high level of capacity before earning a profit. But when passed break even point the profit will increase rapidly. Committed fixed cost has a little effect to the level of costs in the short term. Revenue is the money the company receives for selling their product or service. It is calculated by taking the selling price and multiplying it by the number of units sold. Profit is the amount of money left over after costs have been covered. It is calculated by: total revenue minus total costs. Therefore, profits will not be improved by a greater emphasis on cost management of costs. The company will get profit if the revenue is maintained consistently above break even level. Due to the nature of leisure industry, the product is not in storage so the focus on revenue during the period low level of demand is the necessary task of this company. By adopting a flexible approach the company is adapting the price of the product or service to suit the situation of the company and the amount of money customers are willing to pay. But the given price must be greater than variable cost and above break event point. This pricing strategy is designed to attract as much business as possible when the company has spare capacity. The price will be increased for busy periods when the company can expect to operate near to full capacity. For example: In Vietnam, Da Nang has a long beautiful coastline. Seaside hotels have a high level of demand in the summer (from May to August), this time mainly to serve domestic tourist. The room rates are usually higher two times as much as normal. The hotels have maximum revenue in this period. In the low season from October to February next year, the hotel has launched promotions to attract tourist such as discount 30% room rate at Furama Resort or stay 2 night get 1 night free at Golden Sand Resort. In this case, at times of low volume an inflexible, cost orientated approach to pricing.

Rural to urban Migration in Brazil :: essays research papers

Brazil Investigation ? Challenges Of An LEDC Brazil is the largest and most populace country in South America, and fifth largest in the world in both area and population. Spanning a vast area between central South America and the Atlantic Ocean. Rural To Urban Migration Brazil?s economic development creates wealth like any other country, but due to many different reasons its development has mainly taken place in the Southeast of the country. For example,  · Main ports and air ports are situated in this area making exporting goods easy  · Has the right climate and land that is needed to grow coffee, which is Brazils main export  · It has many mineral resources in the rocks on the coast i.e. iron ore  · It has fast flowing rivers which are a good source of cheap hydro electric power  · It has the best roads and railways in Brazil, making travelling easy. This area is known as the Golden Triangle. At the edges of this triangle there are three major cities, Belo Hoeizante, Rio de Janeiro and Sau Paulo. These are the main ?Favoured? locations for industrial development, normally called the core. People are moving to this part of Brazil because of many reasons, the main one being the jobs at the ports and in the factories or industry, these being mainly secondary (manufacturing) and tertiary (service) sectors. But also it has the best standard of living and the best transport links. Some people live in the skyscrapers with maids, if the earn enough, but if they don?t, then their families have to live in favelas. These are like wooden houses with no main water or electricity. In most countries, the level of wealth decreases with distance from the core. The poorest regions are usually found towards the periphery of the country. The periphery is the area around the core that has not benefited form the economic growth, and development. Most of the wealth is in the centre of Sau Paulo. But the economic development is uneven, as round the edges of Sau Paulo it is a very big contrast. The families are large so all the children can go out and earn money for the family, which is leading to overcrowding and a high birth rate.

The Silver Linings Playbook Chapter 31

Letter #2-November 15, 2006 Dear Pat, First, let me say it's good to hear from you. It's been a long time, which has been strange for me. I mean, when you are married to someone for years and then you don't see that person for almost as many years, it's strange, right? I don't know how to explain it, especially since our marriage ended so abruptly and scandalously. We never got a chance to talk things over – one-on-one – like civilized adults. Because of this, sometimes I think maybe it's almost as if I'm not really sure the multiple â€Å"Pat-less† years have truly transpired, but maybe it's been only a brief separation that feels like years. Like a solo car ride that takes all night but feels like a lifetime. Watching all those highway dashes flying by at seventy miles an hour, your eyes becoming lazy slits and your mind wandering over the memory of a whole lifetime – past and future, childhood memories to thoughts of your own death – until the numbers on the dashboard clock do not me an anything anymore. And then the sun comes up and you get to your destination and the ride becomes the thing that is no longer real, because that surreal feeling has vanished and time has become meaningful again. Finally making contact with you is like arriving at the end of a long car ride and realizing I went to the wrong place – that I have ended up in the past somehow, at the port of origin instead of the dock of destination. But at least I finally get to say that to you, which is important. It probably sounds stupid, but maybe you know what I mean. The part of my life you once filled has been nothing but highway dashes since you were put away, and I am hoping this exchange of letters will help to provide closure for both of us, because soon I will drive back to the place I was before Tiffany contacted me, and we will be only memories to each other. I can hardly believe how much you wrote. When Tiffany told me you were writing me a letter, I did not expect you to give her two hundred photocopied pages of your diary. As you can imagine, Tiffany was not able to read me all of the pages over the phone, because that would have taken hours! She did read me the introductory note and then filled me in on the rest, citing your diary often. You need to know it was a lot of work for her to read through the manuscript and pick out the parts she thought I should hear. For Tiffany's sake, please limit your next letter to five pages – should there be a next letter – as reading five pages aloud takes a long time and Tiffany is typing up what I dictate over the phone as well, which is already too much to ask of her. (She really is a phenomenally kind woman, don't you think? You are lucky to have Tiffany in your life.) Maybe it's the English teacher in me, but I feel as though a page limit is best. No offense, but let's try to be c oncise. Okay? Congratulations on your dance performance. Tiffany says you performed flawlessly. I'm so proud of you! It's hard to imagine you dancing, Pat. The way that Tiffany described the performance was very impressive. I'm glad you are taking an interest in new things. That's good. I certainly wish you had danced more with me. Things at Jefferson High School are gloriously shitty. The PTA pushed for online grade books, and now parents have access to their children's grades 24/7. You would hate working here now because of this new development. All parents have to do is log on to a computer, go to the Jefferson High School Web page, enter an ID # and a password, and they can see if their kid turned in his homework on any given day or scored poorly on a pop quiz or whatever. Of course, this means if we are behind on our grading, parents will know and the aggressive ones will call. Parent-teacher conferences have increased because of this. Every time a student misses a single homework, I'm hearing from parents. Our sports teams are losing pretty regularly too. Coach Ritchie and Coach Malone both miss you. Believe me when I say they could not fill your shoes, and the kids are worse off without Coach Peoples at the helm. The life of a teacher is still hectic and crazy – and I am glad you don't have to dea l with this type of stress as you heal. Sorry to hear about your father being aloof. I know how much that used to upset you. And I'm also sorry your Eagles are up and down – but at least they beat the Redskins last weekend, right? And season tickets with Jake, you must feel as though you died and went to heaven. I think it's best to say I am remarried. I won't go into details unless you want me to, Pat. I'm sure this comes as a shock to you, especially after Tiffany read me the many parts of your diary that seemed to indicate you still hope to reconcile our marriage. You need to know this is not going to happen. The truth is I was planning on divorcing you before the accident, before you were checked into the neural health facility. We were not a good match. You were never home. And let's face it – our sex life was shit. I cheated on you because of this, which you may or may not remember. I am not trying to hurt you, Pat – far from it. I am not proud of my infidelity. I regret cheating on you. But our marriage was over before I began my affair. Your mind is not right, but I have been told your therapist is one of the best in South Jersey, your treatments are working, and your memory will return soon; when it does, you will remember how I hurt you, and then you will not even wan t to write me, let alone try to re-create what you think we once had. I understand my blunt response to your very long and passionate letter might make you upset, and if you don't want to write me again, I will understand. But I wanted to be honest with you. What's the point if we lie now? Yours, Nikki P.S. – I was very impressed with your finally reading many of the books on my American Lit. syllabus. Many students have also complained about the novels being so depressing. Try Mark Twain. Huck Finn ends happily. You might like that one. But I'll tell you the same thing I tell my students when they complain about the depressing nature of American literature: life is not a PG feel-good movie. Real life often ends badly, like our marriage did, Pat. And literature tries to document this reality, while showing us it is still possible for people to endure nobly. It sounds like you have endured very nobly since you returned to New Jersey, and I want you to know I admire that. I hope you are able to reinvent yourself and live out the rest of your life with a quiet sense of satisfaction, which is what I have been trying to do since we parted.

Being A Student Essay

Being a student is a full time job. Students work five days a week, seven hours a day. There is a constant load of work that is given to us, and there is a strict set of rules. Being a student is similar to working at a full time job in many ways. Like working adults, students follow a grueling daily routine, which includes waking up early in the morning, focusing for long hours at a time, having to complete a strenuous work load, dealing with unfair teachers or bosses, an extremely high level of stress, a lot of procrastination, and loss of sleep, among others. These are all problems that students and working adults must deal with on a daily basis, but not all similarities between the day of a student and the day of a working adult are negative. Both students and most working adults go through similar ups and downs throughout a typical day, but there is one profession in particular that is so similar to the job of a student that both students and this specific type of working adult are doing their jobs in the same buildings every day. Students and teachers are alike in so many different ways. If one were to observe the similarities in the days of students and teachers, the observations would include both arriving at a school some time between seven o’clock and eight o’clock in the morning, both going to class throughout the day, both having lunch breaks in cafeterias, both being involved in athletics after school, both having the weekends off, as well as spring break, winter break, summer break, and most holidays, both facing daily academic challenges, and both going home at night to do work in order to prepare for the next day. Students and teachers work together in harmony on a daily basis, learning from each other and becoming better people. Neither could prosper in a school environment without the other. Without teachers, students would not be able to learn, and they would have no one to keep them in line when necessary. Without students, teachers would not have a purpose for working in their profession because they would not have anyone to teach. They depend on each other, and, while learning is a full time job for students, and teaching is a full time job for teachers, both bond over their time spent working and learning together at school every day.

Public Policy Lifecycle Example

Public Policy Lifecycle Example Public Policy Lifecycle – Coursework Example Public Policy Lifecycle The public policy making process entails a set of decisions taken by the government to do something or nothing (Dye, 2010). The stages of the lifecycle of the public policy involve identification of objectives, policy formation, adoption of best solutions, implementation, and evaluation. The Affordable Care Act represents a policy that has undergone through the stages of the public policy lifecycle. The policymakers identified that the objectives of the Affordable Care Act were to expand coverage, lower health care cost, and enhance the quality of care to every American during the first stage of policy lifecycle. The policy gained attention and the Senate and House of Representatives adopted the best options and passed it in 2009 and 2010 respectively, after deliberating on an alternative solution in the second stage of the policy-making process (Emanuel, 2014). In the third stage, the policy identified lowering the uninsured rate, reducing health care for cit izens, and providing subsidies as the best solutions to make health care affordable to all. The implementation stage has encountered challenges from the federal courts, state governments, labor unions, and conservative advocacy groups (Emanuel, 2014). Significant reforms such as minimum standards for insurance policies have happened in the evaluation stage. It is important to develop a viable policy adoption in order to reduce the chances failing or stalling the public policy. Policy networks can facilitate or hinder the adoption and implementation of the public policy (Emanuel, 2014). The policymakers should focus on the best implementation practices by explicitly providing parameters such as targets and restrictions in order to ensure the public understands the implication of the policy. It is imperative for the policymakers to consider whether the adoption or amendment of the existing policy offers the best for all the citizens (Dye, 2010). In essence, the makers ought to look at the relative merits of adoption or amendment of policies.ReferencesDye, T.R. (2010). Understanding Public Policy (13th ed.). London: Pearson Prentice Hall.Emanuel, E. J. (2014). Reinventing American health care: How the Affordable Care Act will improve our terribly complex, blatantly unjust, outrageously expensive, grossly inefficient, error prone system. Criminal justice essays

Criminal justice essays Fine: This option tends to be the most commonly used option by the courts. A fine maybe imposed on both summary and indictable convictions. Depending on the nature of the conviction and length of sentence a fine can be imposed alone or in combination with a prison term or with probation. The maximum allowable fine for a summary conviction is 2000 dollars in the case of an individual and 25,000 dollars in the case of a corporation. Prohibitions and Forfeiture: Under certain conditions and in addition to an imposed sentence the courts may direct that a person be prohibited from certain activities. For example a person convicted of impaired driving will be prohibited from operating a motor vehicle for a specific period of time. Another example might be that a person will be prohibited from owning a firearm for a designated period of time. As well certain convictions could result in the forfeiture of property if it was used in the commission of an offence or was obtained through the proceeds of a criminal offence. An example of this might be that the Crown might require the person to forfeit their boat if it was used in the commission of a drug importation conviction. Absolute and Conditional Discharge: These options are used for first time offenders charged with minor offences. When an individual receives an Absolute discharge, he/she is discharged from the courts and has no further obligation to the justice system. An individual who receives a conditional discharge is subject to conditions of a probation order. Violation of these conditions or further convictions could result in the conditional release being revoked and conviction on the original offence for which he/she received the conditional discharge. Incarceration: The courts can impose a provincial or federal term. The sentence imposed will be determined by the nature of the offence and conviction. A provincial term is any sentence up to two years less a day. ...

Medical Law Essay Example | Topics and Well Written Essays - 2000 words

Medical Law - Essay Example Moreover, the evaluation of the physicians, with regard to the continuance or otherwise of the patient’s life, is bestowed with primacy. In many instances the courts have agreed with the physicians’ evaluation that it would defeat the best interests of the patient to continue with life prolonging medical measures (Mendelson & Jost, 2003, p. 131). The 1993 case of Airedale NHS v Bland proved to be a landmark case in the area of cessation of artificial feeding and therapy. The court permitted the withdrawal of treatment from persons in a persistent vegetative state (PVS). In this case, the defendant Anthony Bland was in PVS as a result of having been asphyxiated in a stampede. The physicians attending upon him proposed the discontinuation of artificial feeding and antibiotic therapy (Tibballs, 2007, p. 233). Subsequent to undergoing a persistent vegetative state for three years, a court order was procured by the physicians attending upon Bland. This order permitted the me dical authorities to write finis to the indignity and degradation that had become an integral and overwhelming component of this hapless individual’s life. It was the considered opinion of the judges, ruling in this case that the inability of Bland to execute a will had prevented an earlier end to his pain and indignity filled life (Docker, 2000). It was clearly realised by the medical authorities that such cessation of feeding and treatment would result in death by starvation. However, such a course of action would not cause discomfort to the patient. It was also assumed that it would be in the best interests of Bland to legally discontinue the life sustaining treatment and tube feeding. Lord Hoffmann opined that the discontinuation of treatment was not only in the best interests of Bland but was also aimed at stopping the humiliation being undergone by him and to prevent distress to his family members. According to Lord Mustill, Bland had to be allowed to die in the best in terests of the community. He further stated that this decision was in the best interests of the family members of Anthony Bland (Tibballs, 2007, p. 233). While pronouncing judgement in the Bland case, one of the presiding judges stated that the States of the Union in the US, which had enacted laws to permit living wills, there was an explicit exclusion of terminating life by discontinuing nourishment and hydration (Ozimic & Fleming, 2011). It is the duty of a doctor to take into account, the best interests of a patient. However, there is an erroneous presumption that the best interests of the patient can be determined only by reference to the patient’s wishes, prior to his becoming incapacitated. The choice exercised by a patient need not necessarily be in his best interests, on every occasion (Ozimic & Fleming, 2011). In addition, ignoring the wishes of an incompetent person, should not be invariably be deemed to be disrespectful to the patient, and in contravention of his r ights. Although, patient autonomy is of considerable significance, doctors take other factors, such as life and health, and the provision of adequate health care in order to support the health and life of the patient. With respect to an incapacitated individua

Reading report - Essay Example These fields are the information and communication field, and the health provider field. As far as these two fields are concerned, a concerted and fused background could be given in relation to the study that was undertaken, without having to give a separate background to the two fields of study. This is because, over the years, there has been great talk of the need to modernize the health sector to make it have its fair share of the technological advancements that are happening all around us (Gardener, 2009). Indeed, there have been both national and local sector reforms that have over the years ensured that health care delivery was improved and that the fulcrum of improved service was with the use of technology. If for nothing at all the digital health record system can be mentioned as a long term intervention that is being used by the health directorate to achieve improved results. There has also been the digitalization of database systems in the healthcare sector. These sector re forms indeed favor the position of IBM as an information and communication company to have a good business marriage with the health sector. The study was conducted following the qualitative method of research whereby the author made use of a lot of secondary data as compared to primary data. This is to means that the author, who also acted as the researcher of the study, did not have to depend on data coming directly from the field of study that were collected by the researcher. Rather, as part of the provisions of qualitative research, the researcher collected data from existing sources that could be trusted as reliable, authentic and empirical. To this effect, there could be several references made to people who have given different versions of accounts to how IBM strategized itself into become a global giant and surmounting the wind of economic turbulence that blew all across the globe. There exist several managerial implications of the current study. Most of these

The technological advancements that have changed human lives Essay

The technological advancements that have changed human lives - Essay Example The innovation of computers and cellphones changed our mode of communication, accuracy, efficiency, and speed of doing things. This has led to complex interactions between humans and machines, which changes our values and culture. As such, there are questions regarding the long-term effects of technology and the possibility of technology conquering us. In this context, there are two concepts of technology, which include Wilbur Mercer and Buster Friendly. This paper will give a detailed answer as to whether I am Wilbur Mercer or Buster Friendly and, more importantly if it matters who I am. In doing this, the paper will rely on evidence from Do Androids Dream of Electric Sheep? By Dick, Phillip K and a video presentation by Amber Case entitled â€Å"We’re All Cyborgs Now† among other scholarly sources. Wilbur Mercer symbolizes Mercerism that is a technology product, which defines a religion created by emotional connections by people from everywhere. It also encourages int eractions with other humans with a view of sharing the suffering and teaches its members to treat their neighbors the way they would want to be treated (Landsberg 38). On the other hand,  Buster Friendly is a technology product that depicts a media personality that derives an alternate media reality and offers entertainment on Earth (Sims 132). Seemingly, the show seeks to convince people that what has been happening lately is fine and normal and claims that Mercerism is a false religion (Rossi 262). There are various critics and praises for in Wilbur Mercer or Buster Friendly in the novel Do Androids Dream of Electric Sheep. Notably, the two compete for humans' attention and the resultant control of humans' thoughts. This manifests the strength of technology on humans to their oblivion. Personally, I chose to be Wilbur Mercer. It is quite clear that the modern society values religion as one of the fundamental aspects of human life. Ideally, religion derives spiritual teachings an d morals that control actions and dominate our personal thoughts and decision-making in our daily lives. As such, the use of religion in the novel, â€Å"Do Androids Dream of Electric Sheep?† is very significant and I support it. Indeed, in this novel, Dick portrays a wide range of religious analogies and references and manifests how humans rely on religion in times of isolation, war, distress, destruction, and instability. Actually, Dick confirms that Mercerism that in the novel acts as the people’s religion is fundamental in deriving hope and unity among human beings in times of dire need. Dick devised his story to reflect human life in 2021 where there was nuclear war fought by rockets and the effects of the nuclear fallout and radioactive dust that plagued the Earth (Dick 4). This created a sense of dire need and desperation. Dick portrays the plagued Earth as an uninhabitable place after the human beings engineered its destruction (Dick 16-17). However, he shows s ome inhabitants who remained and suffered on Earth due to the harsh and isolated conditions they lived in. Most assuredly, this a destitute condition where there are very few people surviving and hence the need for Mercerism. Notably, Dick displays Mercerism as a mass religion criticized by many people at his time (Dick 20-27). This would indeed reflect a religion like Christianity, which is facing critics among scientists. Indeed, Wilbur Mercer would represent Jesus Christ in this context. In addition, just like people interpreted religion before the scientific evolution, Dick portrays people interpreting Mercerism literally in the novel. Mercerism has far-reaching benefits in that it encourages people to care for other people’s feelings and to share in their suffering. It asserts that if you hurt

Taiwan and the One Country, Two Systems Essay Example | Topics and Well Written Essays - 2500 words

Taiwan and the One Country, Two Systems - Essay Example After the Second World War, the Republic of China, led by their leader by then, was the governing polity in the island. Following the Chinese civil war in 1949, the government of the Republic of China withdrew their control of Taiwan. In 1952, Japan officially renounced all territorial rights in San Francisco Peace Treaty. The KMT ruled Taiwan as a single party state for four decades, until democracy was realized in the 1980s. These reforms which were instigated by Chiang Ching-Kuo who was then the leader in the mainland China were continued by his predecessor Lee Teng-hui, which eventually led to the first presidential election in the island in 1996. Until today, the island is a democracy with a presidential system of governance. History and creation of â€Å"one country, two systems† policy (Deng Xiaoping) â€Å"One country, two systems â€Å"translated as â€Å"one China, two systems† is a constitutional principle that was established by Deng Xiaoping. Deng Xiaoping was an executive leader of the People’s Republic of China. His purpose in formulating this principle was major to reunify China during the early 1980s. This leader gave suggestions for the establishment of only one China, but different regions such as Macau, Taiwan, and Hong Kong to retain their capitalist political and economic systems while the rest of China to remain on a socialist system. Under this principle, Macau, Taiwan, and Hong Kong regions should go on with their legal, political, financial or economic affairs including how they relate to other foreign states.

Drug Abuse Essay Example for Free

Drug Abuse Essay Drug abuse has an effect on all aspects of life; overall health and wellness, family life, and the community. With there being so many different kinds of drugs the effects are endless. The effect of drug abuse does not discriminate or focus on any one person. Drug abuse can be found in any area of the world and the overall effects can be devastating to anyone involved. A person’s choice to use any kind of illegal drug or abusing prescribed medicines can have a damaging impact on their overall health and wellness. This damaging effect on addicts overall health and wellness can be both short and long term. An active addict can face many health changes and challenges throughout the time that they choose to use. There can be many short term effects that depend on exactly what drug is being abused. There are drugs that can raise your heart rate, make you hallucinate, and even dehydrate you badly. â€Å"The impact of addiction can be far reaching. Cardiovascular disease, stroke, cancer, HIV/AIDS, hepatitis, and lung disease can all be affected by drug abuse. Some of these effects occur when drugs are used at high doses or after prolonged use; however, some may occur after just one use.† An addict can face many mental health issues during their addiction that can have a devastating effect on their own life. Women substance abusers are more likely than men to have poor self-concepts (low self-esteem, guilt, self-blame) and high rates of mental health problems, such as depression, anxiety, bipolar affective disorder, suicidal ideation, psychosexual disorders, eating disorders, and Post traumatic stress disorder.† â€Å"Chronic use of some drugs of abuse can cause long-lasting changes in the brain, which may lead to paranoia, depression, aggression, and hallucinations.† The addict has a giant effect on their family and home environment. There can be many issues that a family must face when an addict is living in the home. There can be many forms of abuse in a home where there is an addict. There can be sexual abuse, financial abuse, physical abuse and emotional abuse in any home. The addiction is not responsible for the violence but can intensify and make it more common. When an addict is deep in their addiction they will often put financial responsibilities of the home off to get high instead. This can cause child neglect by no food being in home, no  electricity or heat. There can be consequences for the children living in a home with an active addict. These consequences may not show up for years until the child of the addict is grown. â€Å"The disturbed home and family setup, the inter-parental and parent-child conflict, parental neglect in large families, defective disciplinary techniques (too lax or too strict) and family disorganization ar e considered as some of the causes of drug abuse.† There is a higher risk of children of an addict growing up to become addicts themselves An addict has an effect on the community in which they live. This effect from an addict can cause problems for the entire community There is more possibility of crime and erratic behavior in the community where an active addict is living. A defining characteristic of addictive behavior is that they involve in the pursuit of short-term gratification at the expense of long-term harm When a person is under the influence of any drug they may not be fully conscious of the choices that they are making. When there is an active drug area in the community there is usually more violence and less desired living situations. When there are drugs in a common area that area becomes more prone to violence and could actually desensitize the people in the community When you have shootings, robberies, rapes, and murders in any area there will be less of a desire for anybody to want to live there. Conclusion In conclusion with their being so much drug abuse in today’s society where do we begin to help break the cycle? We have seen that the problem is a mental health issue that begins with the addict; however drug abuse has an effect on all aspects of life; overall health and wellness, family life, and the community. If we stop judging the addicts and making them feel so much shame and embarrassment, we can lift them up, encourage them and support them to better then it can change the overall hurt and damage that is being inflicted on our people and society.

Changing Concentration of Hydrochloric Acid

Changing Concentration of Hydrochloric Acid How will changing the concentration of hydrochloric (HCl) acid affect the rate of hydrogen gas (H2) production during the reaction with magnesium (Mg), using the pressure buildup by hydrogen gas? Introduction Factors that influence rates of reactions include change in concentration, temperature, surface area, or the addition of a catalyst. This experiment will specifically investigate the effect of concentration change of the reactants upon the rate of reaction, using hydrochloric acid and magnesium strip. The concentration of HCl acid solution is controlled through serial dilution. 2HCl(aq) + Mg(s) à ¢Ã¢â‚¬  Ã¢â‚¬â„¢ MgCl2(aq) + H2(g) This experiment in particular will explore how the pressure changes as the above reaction proceeds. Because the reaction produces hydrogen gas as a product, building up more pressure within the confined space of a test tube, a pressure sensor will measure the rate of reaction. After the reaction begins, approximately 20 seconds of data will be collected with each trial, in order to formulate a common trend (a graph of pressure over time). With average slopes of different amount of concentrations, a linear regression line will then be created to sketch the trend, regarding the effect of concentration upon pressure-the rate of reaction. Hypothesis According to Collision Theory, the reactant particles must collide together, and thus creating a reaction. Because increasing the concentration of HCl acid solution also means an increase in the number of hydrogen and chloride ions, collision between the reactant particles increases as well, resulting in more products-hydrogen gas. With more production of hydrogen gas in the confined test tube, pressure will build up. Therefore, if-at a given period of time-the concentration of HCl acid solution increases, then the rate of reaction will increase accordingly, because more collisions will occur, producing hydrogen gas at a higher rate. Variables Variable description Method of measuring variable Dependent variable Pressure buildup due to the reaction between hydrochloric acid solution and magnesium During the reaction, H2gas is produced, thus increasing the volume within the confined space of a test tube and increasing the pressure. This change will be recorded by a pressure sensor. Collecting data for about 10 seconds before the injection of the magnesium strip, the measurement of pressure will continue for about 20 seconds after the reaction begins. Three trials are required for each concentration of HCl solution to minimize random error. Rate of reaction Using the more accurate initial rate of the reaction, about 10 seconds of the graph after the reaction begins will be used to create a slope of change in pressure over time. Independent variable Concentration of HCl solution Using serial dilution along with apparatus such as micropipette and flask, the 1M hydrochloric acid solution will be diluted into 0.5M, 0.25M, 0.125M, and 0.0625M. Controlled variables Mg strip (length) Using a ruler and scissor, the Mg strip will be cut into 15 pieces, each being 1cm. Volume of hydrochloric acid solution For each concentration, 3cm3of hydrochloric acid solution is used, accurately measured by a pipette. Temperature of reactants The temperature remains constant at room temperature (approx. 25 degrees Celsius) throughout the entire experiment. Shaking of the test tube To create the most accurate results possible, physical motion when slightly shaking the test tubes must be repetitive in the same way for each trial. Size of the test tube Because different sizes of test tubes would mean different volumes as well, constant size (volume) is essential, preferably small so that the reaction will be more conspicuous. To do this, 15 identical test tubes are used. Table 1: List of Variables Apparatus and Materials 1M hydrochloric acid solution Distilled water Magnesium strip Flask (50cm3) Pressure sensor Logger Pro Micropipette 15 identical test tubes Sandpaper Scissor Procedure Put 20cm3 of 1M HCL solution in the flask and dilute it to 0.5M with 20cm3 of distilled water. Using the serial dilution as in step 1, prepare 10cm3 solutions with concentrations of 1M, 0.5M, 0.25M, 0.125M, and 0.0625M. Add 3 cm3 of each solution into labeled test tubes using the micropipette. Repeat step 3 to prepare three test tubes of each solution (15 in total) Cut out the magnesium strip into 15 pieces of 1cm and sand them with sandpaper. Put the cut out magnesium strip into the test tube with 1M HCl solution. Then quickly cover the test tube with the pressure sensor. Start collecting data while shaking the test tube in a consistent manner for about 25 seconds after the reaction begins. Repeat steps 6 to 8 for all other test tubes. Data Collection and Processing Qualitative Data After the injection of the magnesium strip into the HCl solution, it effervesces and pressure inside the test tube begins to build up. With test tubes of higher concentration, the pressure seems to be higher within the time limit and more bubbles form. At the end of the reaction, the solutions color changed to transparent yellow. The reacted solution (product) gives off a foul smell. Processed Data Data Presentation 1 0.5 0.25 0.125 0.0625 Uncertainties Standard Deviation Standard deviation was calculated and represented in the rate of reaction vs. concentration graph as error bars. Standard deviation for different concentration of HCl solution Standard deviation was calculated by a graphing calculator. Uncertainty due to the serial dilution of HCl solution Uncertainty due to 1cm3 Uncertainty during dilution measuring pressure (?) Conclusion In Figure 1, the trend of different concentrations of reactants influencing the rate of reaction is illustrated. The linear regression line demonstrates the clear change in rate of reaction, according to the change in concentration-the lower the concentration, the slower the rate of reaction. Hence, the initial hypothesis, stating the direct relationship between concentration and rate of reaction, is justified and validated. Evaluation Shown by Table 4, in which the standard deviations for each concentration of HCl solution are calculated, the results of this experiment are fairly precise, but not to a great extent. Moreover, uncertainties created during the preparation of the experiment, as with the management of apparatus and materials such as the gas pressure sensor, flask, and micropipette decreases the accuracy. Although Figure 1, the graph containing the general trend of concentrations effect upon the rate of reaction seems to validate the hypothesis, the rate of reaction of 0.25M HCl solution stands out of the trend, decreasing the validity of this experiments results. More factors that may have hindered obtaining accurate results of this experiment include: Error Impact Improvements Using hand to shake the test tubes for faster reaction rate Any non-perceptible (by humans) changes influenced each reaction to proceed differently, ultimately creating different circumstances for each trial. This change in circumstances is crucial since it greatly hinders accurate results. The use of a vibration plate instead may reduce error as it is more consistent. Reproducible circumstances can be better achieved.

Mitochondria Essay -- essays research papers

Mitochondria Mitochondria are tiny organelles found in nearly all eukaryotic cells. They are rather large organelles ranging from 0.5Â µm to 10Â µm in length and 1Â µm in diameter. The mitochondria are the energy factories of the cell and are located in the cytoplasm. They are the sites of cellular respiration. The mitochondria are responsible for generating ATP from such organic fuels as simple sugars and fats in the process of cellular respiration. This doubled-membrane organelle has its own DNA and can reproduce by splitting itself. The mitochondria are sausage-shaped structures that move, change their shape and divide. They are distinct organelles with two membranes, the inner membrane and the outer membrane. The outer membrane is smooth and limits the organelle. It is highly permeable to small solutes such as molecules and ions, but it blocks off passages of proteins and other macromolecules. The inner membrane of the mitochondria is folded into shelf like structures called cristae. The cristae does not even allow the passage of small ions and so it maintains a closed space within the cell. The many infoldings of the cristae are responsible for providing the mitochondrion with a large surface area which enhances the productivity of respiration. The inner membrane and outer membrane effectively divide the mitochondria into two internal compartments. The space located between the outer and inner mitochondrial membrane is called the intermembrane space. The space enclosed by th...

Cinderella - Oppression of Women by Women Essay -- Comparative Litera

Cinderella - Oppression of Women by Women Throughout the ages women have always appeared to be victims of oppression by men. There are many cultures and religions that have separate rules for the men and the women. Traditional gender roles have cast men as the providers, while women are the nurturers and stay home to keep the house clean, cook, and care for the children and their husbands. Even the clothes men and women wear are subject to the different rules. Men are free to dress without restraint in order to get the job done, where as women are required to dress modestly - in some religions covered from head to toe, and compelled to cover their hair in others. However, the fairy tale of Cinderella turns the idea of male repression of women on its head, casting women in a position of dominance. It is still a man's world where women must bend to the demands of man, the ball for example. It is in these confines, the ultimate goal in obtaining a suitable husband, that we see what women are capable of doing to one another in o rder to reach their goals. Women use different techniques in order to keep other women down. As Tony Morrison states she is "alarmed by the violence that women do to each other: professional violence, competitive violence, emotional violence. [She] is alarmed by the willingness of women to enslave other women." (Cinderella's stepsisters, p. 500) In this situation, the women in Cinderella, specifically the step mother and step sisters, dominate Cinderella in many ways: name calling, degradation, mocking, and dishing her false hopes. The story as portrayed in Cinderella by Charles Perrault, Ashputtle by the Grimm Brothers and the Walt Disney adaptation written by Grant as well as the animated film Cinderell... ...PHY Behrens, Laurence and Rosen, Leonard F.Writing and Reading Across the Curriculum. “Simplicity” by William Zinsser

William Zinsser in his essay, â€Å"Simplicity,† describes the tendency people have to inflate their own words. A majority of us think that something is missing if a word or sentence is too simple causing us to add unnecessary information only to confuse our readers. Zinsser shows us examples of this in everyday life such as a simple letter, or a brochure by an insurance company, where the corporation uses a statement that overuses vocabulary to express something so simple. Zinsser observes that, â€Å"Clear thinking becomes clear writing; one can’t exist without another†,(Zinsser 175) His opinion on the key towards becoming an excellent writer is to take every sentence and to shorten it so that each word has its set function. As a writer, he believes the more clearheaded one is while constructing a piece of work, the better result they will receive. Writing is not as easy as it may seem. It can take several trials of perfecting one’s work and more importantly revisions of one’s thoughts like Zinsser’s writing. The more conscious you become to your writing allows the writer to easily express their words and in society, good writing seems to be what lacks the most. Zinsser believes that a clear mind can positively impact your writing like a clear mind can affect your performance in everyday life. Sometimes, the more homework I have and the more hours I work, seem to build to my stress and negatively affect me in school. My weekly schedule is one that at times is pretty hectic. With school, work and friends, sometimes the juggling of the three seem to reach a boiling point. I currently work at a waitressing job in which the night shifts are usually the ones that benefit me the most. I attend school at Hunter College 4 days a week. Mondays and Thursdays from 8 am to 4 pm, while Tuesdays and Fridays are from 11 am to 1 pm. My work schedule is for the most part from Tuesday, Thursdays, Fridays, Saturdays, and Sundays (mid day to late nights). Going to school four days a week and working 5 days a week is such a hassle in my life. I try to fit my social life in as well yet, sometimes it seems impossible. That’s when I realize by not going out I might be jeopardizing my friendships. Working almost five days a week doesn’t give me enough time for myself or the ability to focus more on school. I come home so late that I usually stay up studying till 2 or 3 in the morning but have to wake up by 6 am. I run on 3 or 4 hours of sleep which doesn’t give me enough energy to function at my highest capability. About two weeks ago I reached a point in my life in which I was beginning to feel like a robot. On a Friday night, I came home from a long day at school, immediately headed to work knowing that I had two tests to study for Monday. Now I was scheduled to work the whole weekend on night shifts that I was struggling to figure out how I could possibly fit in time to study. I tried my hardest to study in between work breaks, but the environment around me was pretty hectic, that I accomplished nothing. On Saturday and Sunday, I woke up a little earlier to study, but time was passing by so fast that on both days I only accomplished an hour or two to memorize some material. I would rush each day to start getting ready for work and to call my cab to get there on time. That Sunday from work I got home at 2 am and studied an hour for history, until I fell asleep on my books. I instantly woke up, almost late for school, just in time to make it to my English class. I was so tired that I was straining to make my eyes remain open. I had a few school breaks in between my classes, but I knew that I couldn’t memorize all these material for two different subjects the day of the test. Taking both of those tests, made me realize that not only did I fail, but I needed to make some changes in my life. My first priority is attending and excelling at school and juggling too many days at work with school is almost impossible to do. I knew I had to change my work schedule so that I have enough days to study and nights to rest in the future. In the end I knew it would work out even if I cut back on days to earn money, because my body and mind need to properly rest. We don’t seem to realize but sometimes there are many unnecessary things we do that can easily be adjusted. Either working too much or spending time doing other activities can take up a lot of our energy. As Zinsser illustrates simplifying one’s life or one’s writing is possible and necessary at times, and if we all learned to do so life would be much easier.

Can feminism be thought of as a theory of law Essay

As a concept, feminism is very much a modern notion within legal circles, which aims to eradicate any prejudice against women’s rights. This in a society strongly founded upon a male-orientated legal system, which historically fails to recognise the social and legal rights of women, and instead focuses upon â€Å"male-orientated theories and ideologies.†1 It is this patriarchy that feminists thrive to eliminate. The essence of patriarchy is emphasised by the Marxist legal theory, developed by Karl Marx and Friedrich Engels in the 19th Century, which places no emphasis upon gender, and consequently belittles the feminists fight for gender equality. Juxtaposed with the rigid Marxist approach to legal rule is the postmodernist dialect that offers a â€Å"positive method of forcing individuals to confront and change the rigid contexts and structures (including laws) within which they have arbitrarily confined themselves.†2 The ideology of feminism is split into three distinct categories, all of which work towards one common goal of removing gender prejudices: 1) Liberal feminism is grounded in â€Å"classical liberal thinking that individuals should be free to develop their own talents and pursue their own interests. Liberal feminists accept the basic organisation of our society but seek to expand the rights and opportunities of women. Liberal feminists support equal rights and oppose prejudice and discrimination that block the aspirations of women.†3 2) Socialist feminism is an evolution from Marxist conflict theory, essentially made in reaction to the little attention Marx paid to gender. Socialist feminists argue that the â€Å"bourgeois family must be restructured to end ‘domestic slavery’ in favour of some collective means of carrying out housework and child care. The key to this goal, in turn, is a socialist revolution that creates a state-centred economy operating to meet the needs of all. Such a basic transformation of society requires that women and men pursue their personal liberation together, rather than individually, as liberal feminists maintain.†4 3) The third form of feminism is radical feminism. This, as the name suggests is the most extreme version of feminism, it disregards the liberal theory as â€Å"superficial and inadequate,†5 and they claim that even a socialist revolution would not end patriarchy. Radical feminists strive to create a society free from any gender inequality by completely abolishing the cultural notion of gender. To look at these three forms of feminism an observer would be ignorant to discard feminism as having no legal influence, as it is clear to see from these that support for such movements is vast and comes in various forms, all of which attack the same enemy, patriarchy, albeit in differing manners. These differing methods are accentuated by recent developments and movements in society, particularly in the 20th Century these can be clearly highlighted by looking at the actions of the suffragettes in 1910, which illustrate a more active approach to campaigning. As previously mentioned feminist legal theories are a contemporary concept, for this reason a â€Å"radical new methodology in legal theory† is required in order to encompass the new issues raised by feminism as a legal theory. Such a new methodology could be found in the ‘critical legal theory’ method, as it would be able to incorporate feminist views such as the theory that a â€Å"male-orientated appreciation of law emphasises individualism and ‘rights’ at the expense of ‘female’ emphases upon interaction and cooperation.† 6 This approach is however, solely a theoretical one, and as such it does not entirely cover the needs of feminism, insofar as â€Å"feminism is only partially and peripherally concerned with academic theorising,†7 the major part of the work of feminism is to promote the â€Å"dissatisfactions of a wide spectrum of women,† which highlight the general inequality felt by women in regards to legal and social equality. Therefore critical legal studies, instead of acting as a definition, are rather a useful means of indicating the â€Å"explicit and implicit male orientation of law and legal administration and the resulting disadvantage and marginalisation often suffered by women.†8 This has led to the recognition of three fundamental elements which personify a feminist legal theory. â€Å"These are: a) asking the ‘woman question’, i.e. the extent of the presence and recognition of women’s experience in law; b) feminist practical reasoning, meaning a reasoning which proceeds from context and values difference and the experience of the unempowered; and c) consciousness raising, meaning an exploration of the collective experience of women through a sharing of individual experiences.†9 These three elements, outlined above by Katherine T. Bartlett, are designed to act as the source for future feminist legal theory development, particularly in respect of women’s outlook upon law with the intention of improving women’s legal position in the future â€Å"development or redevelopment of law.†10 The legal evolution, or, redevelopment, mentioned above is one in which women strive to see a revolution from an â€Å"inherently ‘male’ legal mindset implicitly discriminating against women because it is framed in terms of male experience which does not necessarily relate to that of women.†11 That is to say, that in numerous situations women are expected to mirror full-time, long-term and unionised male workers, when in reality women digress from this norm insofar as their working patterns tend to be far more interrupted and part-time. From this a clear paradox is produced, as feminists while thriving to be treated as the males equal simultaneously require a variant from this norm in order to account for their differing responsibilities. This attitude is stressed distinctly by the remarks of Joanne Conaghan and Louise Chudleigh, when they say, â€Å"labour law both embodies and conceals the gender division of labour and, by focusing exclusively on the world of paid work, ignores the differing responsibilities [of] †¦ men and women.†12 Such inadequacies within the legal system are numerous and ironically even legal structures that aim to eradicate gender discrimination can be seen to be based upon analogies created from â€Å"irrelevant, and sometimes outdated, male experience.† An unmistakable example of this is the treatment of maternity leave as analogous to the sick leave of their male counterpart. This is coupled by the notion that parenting is predominantly the female’s role, which is highlighted by the â€Å"very limited provisions for paternity leave.† 13 The underlying problem here is that, in order to be treated fairly and without any prejudice women are required to meet a norm set by existing male experiences which by there very nature do not create a balanced equality, and thus â€Å"existing legal standards and concepts disadvantage women†14 as they merely incorporate women into existing male-orientated legal structures, rather than recreating the legal structures so as to be established upon male and female requirements. The above mentioned relationship between female legal theory and critical legal studies creates a clear enhancement, in regards to political knowledge and understanding of feminists legal argument, and consequently for the female legal theory. The noticeable thing to emphasise from this is the â€Å"disadvantaging effect of concealed and frequently unrealised bias in a legal order which has for the most part developed from male rather than female experience,†15 and has therefore produced a rather lopsided legal system in favour of men. This prejudice has now been identified, thanks to the relationship between critical legal studies and feminist legal theory, this identification can be perceived as a significant legal stepping stone towards a legal system that not only incorporates females, but is instead founded upon female and male experiences resulting in an equality which is not merely all encompassing in terms of a male perspective, but rather an equality that is derived f rom the experiences of both genders. Strongly contrasting the accommodating nature of critical legal studies in relation to female legal theories, are those theories of law and society created by Karl Marx and Friedrich Engels. Their creation, Marxism, a derivative of a much older proposition by Immanuel Kant that stated that, â€Å"every thesis has a contrary antithesis†16 and that eventual resolution of these two contradictory perspectives, through revolution, would end up creating an ‘absolute understanding’. This led to Marx placing specific importance upon an economic foundation from which all things within society, both social and political, are merely ‘superstructure.’ It is for this reason that Marxism has been described as being a distinctly materialistic theory. A strong contrast can be seen between the feminist legal theory, which bases its social beliefs at the apex of its legal structure, and the Marxist theory which states that â€Å"social understanding is seen as an ideological perception of the economic relations existing at a given time which will change as the underlying economic relationships alter.†17 Here it is clear that a Marxist approach would place very little emphasis upon the social question of gender inequality, but would instead focus upon an economic foundation with the speculation that if a high enough proportion of society feel a need to increase gender equality then a revolution would take place. For Marxism social revolution appears to be the basis for the theory to develop. It would therefore appear to be a theory that shows little appreciation for social needs, such as those displayed by the female legal theory. For feminists to advance their legal theory through a Marxist approach, the attitude of socialist feminists, as discussed above, would have to be adopted. That is to say that the â€Å"bourgeois family must be restructured to end ‘domestic slavery’ in favour of some collective means of carrying out housework and childcare. The key to this goal, in turn, is a socialist revolution that creates a state-centred economy operating to meet the needs of all. Such a basic transformation of society requires that women and men pursue their personal liberation together, rather than individually, as liberal feminists maintain.†18 This once again highlights the idea of a union between both genders, encompassing experiences from both so as to enable females not only to be incorporated into an existing legal structure but instead to recreate a legal structure based upon the needs and experiences of both genders. A legal theory that promotes the liberating philosophy required in order to create a society able to accept the alterations needed to adequately unify both genders in a legal sense is the ‘postmodern’ legal theory. This theory, commonly portrayed as a â€Å"recipe for relativism,†19 also displays the characteristics needed in order to force â€Å"individuals to confront and change the rigid contexts and structures (including laws) within which they have arbitrarily confined themselves.†20 In this sense it is the ideal method for women to promote and execute the installation of their female legal theory. As it would not only tolerate an amendment in the law to integrate women into existing law, but more than this it would allow them to â€Å"change the rigid contexts and structures† mentioned above, which have prevented the advancement of gender equality within the legal structure. However, postmodernism also raises some problems in relation to feminist jurisprudence. Hilaire Barnett states that â€Å"there must be developed critiques †¦ which reject the universalist, foundationalist, philosophical and political understanding offered by modernism†¦and in its place there exists diversity, plurality, competing rationalities, competing perspectives and uncertainty as to the potentiality of theory.†21 In general, here she is saying that women must resist generalising their condition within society, and instead focus upon the â€Å"multiplicity of subjectivities, identities, which inhere in the individual.†22 Overall, I believe feminism to be undoubtedly ‘fundamental in some way.’ The critical legal theory discussed above shows how society has failed to display mutuality, not only towards women as members of society but towards men and women, through an â€Å"improper discriminatory selectivity, generate alienation and, ultimately, disfunctionality in the working of a legal order.†23 This inequality has led to the recognition of three fundamental elements which personify a feminist legal theory. Resistance is however, met by a Marxist legal theory, which displays very little appreciation of gender issues. However, a feminist theory could be adopted through the Marxist ‘bourgeois’ revolutionary approach, which would see both genders uniting in a revolution to change the pre-adopted norms of society. This idea of changing preconceived rules and laws within society would allow a feminist legal theory to develop, an idea given weight to by the postmodern legal theory, which also places special emphasis upon withdrawing from a united generalisation of women and instead focusing upon them as individuals. Therefore, I would argue that ‘feminism’ can be thought of as a theory of law, albeit not on the same scale as other theories previously mentioned, such as Marxism. But it’s rapid evolution and recent political and legal enhancement within society makes it a theory with considerable weight, and certainly a theory ‘fundamental in some way.’ 1 Textbook on Jurisprudence – Hilaire McCoubrey and Nigel D. Science Boon and Bane

There are no extents to define science. Science is every where around us. Some people say it is a boon and some say that it is a bane. According to me it is a boon as every thing have both cons and pros, but the decision is made by observing which side is better. Some who would disagree with me and would believe that science is a bane. Everyone have his/her different opinion. But, friend! science is the discovery, it is the mixture of creativity of human's mind with his/her intelligence. You would say that earlier when all the comforts were not available, everything was just perfect as science was not there. But the stone weapons, invention of fire, cave, animal clothing, everything was discovery, creation, creativity, intelligence in short science. There was no human era in which science was not present as without science the human would be even worse than the new born baby who is totally confused and does not know where he is, and what to do, but he at least know that he have to cry, but without science, humans would not be even in that state. So friends, no to science and technology does not only means that there will no electricity, TV , ac, fridge, taps, computers, internet, transport, etc but it means even more, it means that human would be nothing less than being a living corpse. I agree that it can be harmful if in evil hands, but is it the fault of creativity, intelligence, no it is the fault evil mind. They can use anything to facilitate their plans and if this is the case, then according to it, if someone is stabbed, then the knife through which the murderer had killed the victim should be punished and is to be blamed and not the murderer.

Claus Von Stauffenberg Research Paper Example | Topics and Well Written Essays - 1000 words

Claus Von Stauffenberg - Research Paper Example Claus von Stauffenberg was born in Jettingen, Germany on November 15, 1907. (Claus von Stauffenberg) His father was a religious man with a philosophic bent, an accomplished horseman, and a lover of poetry. (Jones) He was the third of the four sons his parent had. He was a bright student and was brought up under better living conditions because of his aristocratic family background. He and his brothers were brave peoples and they joined the German scout agency during their youthhood. At the age of nineteen, he became an officer cadet because of his smartness and abilities. His intelligence and smartness have made him a commissioned officer in 1930. He has trained specifically in using modern weapons and war equipment during this period. Although he has supported some of the policies of the Nazi regime and Hitler, many other policies of Nazis were indigestible to him. His strong moral backgrounds forced him to disagree with many of the Nazi policies. He has participated in most of the wars Germany conducted during this period. Conquest of Poland, 1939, Battle of France, 1940, Operation Barbarossa, 1941, the campaign against Russia in 1941, Tunisian operations, and 1942 were some of the major wars he has participated. Initially, Stauffenberg thought that some of these wars were justifiable for the interest of Germany as a country, the mass murder of Jews in 1942 by Nazi-led Germany forced him to think against Hitler and his regime more strongly. He has realized the hidden agenda Hitler had in killing Jews and expanding his power. He has realized that Hitler is becoming a strong threat not only to the Jews but even for the rest of the world as well. In the Tunisian operation, he has suffered severe injuries and lost one of his eyes and hands and almost met with death. He was forced to spend 3 months in hospital where the thought about dethroning Hitler and the Nazi regime first came into  his mind.

The motivations of Chinese EFLs Term Paper Example | Topics and Well Written Essays - 3750 words

The motivations of Chinese EFLs - Term Paper Example People who are fluent in English are given almost celebrity-like honor and value in countries where English is not the official language. The wide ranged usage of English throughout the world be it, mass media, education, Internet, business, tourism, technology and such other fields is what gives the language an authoritative appeal and command over the whole world. Acknowledging the importance of the English language, the government of every country needs to be capable of providing facilities for the children to learn this language. Thus, this is the reason why English is being taught in almost all countries. Therefore, it is the responsibility of the parents to get their children enrolled into schools that teach English. It also becomes the responsibility of these children to learn well and excel in their academics to make their parents feel proud and in turn, serve their nation by staying committed to their jobs, which obviously, would require English as the main language. Therefo re, for students to learn languages, other than their mother tongue, they need motivation. The paper at hand focuses on Chinese EFL students. These refer to the students who come from China and settle in America or other such countries where the official language is English, and study English as a foreign language. It also includes EFL students who reside in China itself. Studies show that China accounts for the â€Å"largest number of English language learners in the world† (Influence of Instrumental Motivation on EFL Learners in China and its Implication On TEFL Instructional Design 1). According to JUDY F. CHEN in his article called, Motivators That Do Not Motivate: the Case of Chinese EFL Learners and the Influence of Culture on Motivation, the Language learning theory has widely accepted the saying that language learners with superior levels of motivation will be superior achievers. Finding what composes motivation for those who learn the language in a variety of cultura l settings remains a significant and difficult task. Motivation study frequently centers on cultural circumstances that are not very different from European values and North American. Language learning motivation study outcomes have tended to support the supreme importance of integrative motivation, which was primarily described by Gardner and Lambert (1972) and the newer version by Shaaban and Ghaith. Integrative motivation is successful because language abilities are perceived as essential to participation in various social groups that employ the target language. Noels, Clement, Pelletier, and Vallerand (2000) make out the preeminent significance formerly granted to the orientation of integrative motivation, but also state that this can be the case only in particular socio-cultural circumstances. Integrative motivation is frequently contrasted by way of the more outwardly affected instrumental motivation (JUDY F. CHEN 2005). The students face a lot of problems in their everyday li fe in the educational institutions they attend. This is due to the fact that English is totally foreign to them until they go abroad. Thus, there arises a great need for these students to be motivated. This paper therefore addresses various problems that the Chinese EFL students face in learning English, the

Evaluate the role played by Britain in shaping modern Australian Essay

Evaluate the role played by Britain in shaping modern Australian society and political culture. Does the term 'Austral Briton' still hold any relevance - Essay Example A good and profound example is the Head of State who is the current Queen of England. The other is the Union Jack symbol in the Australian flag. Many Australians as at the WWII either descended from Britain or were actually having direct ancestral links to Britain2. This paper will therefore discuss the role played by Britain in shaping modern Australian society and political culture while shedding light on whether the term ‘Austral Briton’ still holds any relevance. Before the 1st World War Australian inhabitants especially the ones born there or had their ancestry trailing from Britain or Ireland were being termed as ‘Aussie’ colloquially. This was rather a term that denoted ability to survive through hard times and later was more defining as it distinguished those born in Australia and immigrants3. This latter distinction was coined during and after the 2nd World War. The nation was originally a British penal colony from 18th century and more precisely from 17884. The continent had been seen to be one that is full of hardships by Joseph Banks who went further to suggest that convicts should be taken there from Britain. It is in 1788 that the first batch of convicts docked at Botany Bay5. This first fleet comprised of marines, men and women convicts. The following years saw an increased movement to Australia as more convicts were being shipped and being taken further inland. The women population among the convicts was just 20 perc ent. This disparity between men and women convicts went a long way to shape the current mateship ideology. This transportation of convicts to Australia however came to an end officially in 1850. More and more people started to stream in from various nationalities but the biggest number was from Britain making them dominate the demographics of Australia6. Australia was a region of the earth where democracy did not exist as a formal system of ruling masses up until the colonisation by the British. Most

Read and answer question Essay Example | Topics and Well Written Essays - 250 words - 3

Read and answer question - Essay Example Both the organization and its shareholders need returns for their investments and when such is not achieved then change is inevitable. 2. What is the primary type of change needed- Changing things or changing the people and culture. Can the Wisconsin plant be saved by changing things alone, by changing people and culture, or must both be changed? The primary type of change needed for Wisconsin plant is for people and culture. With some current Wisconsin employees telling of how their fathers worked for the same plant, calls for a change in the people. Once people get used to a place, they reduce the quality of production, which could be the contributing factor towards the competitors almost producing better quality than Wisconsin plant. It is also clear that Wisconsin employees are the most paid compared to the others. The culture of the union determining their pay should, therefore be changed too in an urge to reduce the plant’s high production costs. 3. What do you think is the major underlying cause of the Union’s resistance to change? If you were Jim Malesckowski, what implementation tactics would you use to try to convince union members to change to save the Wisconsin plant? It is evidently clear that if no change is made, then the Wisconsin plant will have to close down due to the high operational costs. If I was Jim, I would dialogue with the union be telling them that if change was not achieved then the plant would close down. In the event that happens then all the employees would be jobless. In changing to a save culture, the union members would benefit in that despite the reduction in their salaries, they would still retain their jobs, other than letting the plant close down leaving all of them jobless as a result of the high operational
